Two Sexes Only!’ Executive Order Attacks Transgender People

Magazine, Living Well

The recent executive order signed by President Donald Trump, which legally recognizes only male and female sexes, has sparked widespread concern within the LGBTQ+ community. By effectively erasing transgender and non-binary identities from legal recognition, the order threatens rights in critical areas such as healthcare, education, and personal identification. This measure comes at a time when hate crimes against transgender individuals are on the rise, amplifying distress among activists and advocates.

In a roundtable discussion hosted by Ethnic Media Services, experts examined the policy’s implications, its toll on the transgender community, and strategies to challenge it.

Dr. Ilan H. Meyer, a distinguished scholar from the Williams Institute at UCLA, highlighted the profound health impacts of such policies. His institute’s research estimates that approximately 1.6 million transgender individuals in the U.S. are above the age of 13, along with 1.2 million non-binary adults and 5 million intersex people—many of whom will be affected by this executive order.

Dr. Meyer expressed deep concern over the policy’s strict definition of biological sex as either male or female at birth, a concept he deemed scientifically inaccurate. This definition would prevent transgender individuals from obtaining identification documents that reflect their gender, leading to challenges in travel, employment, and accessing social services. It also impacts transgender individuals in prisons, homeless shelters, and other federally funded institutions, increasing their vulnerability to violence and discrimination.

One of the most alarming aspects of the executive order is its prohibition of gender-affirming care, particularly for minors. Dr. Meyer noted that revoking non-discrimination protections fosters a hostile environment that legitimizes prejudice. He pointed to California’s Transgender Respect, Agency, and Dignity Act (SB 132), which sought to protect transgender individuals in the prison system but has faced legal challenges from groups opposing trans rights.

The discussion also touched on the broader societal impact of the policy. Research has shown a direct link between anti-trans rhetoric and increased violence. Dr. Meyer cited studies following the 2016 election that demonstrated a spike in hate crimes in counties where Trump held rallies. Violence against transgender individuals is already disproportionately high, with Black and Hispanic transgender individuals facing an even greater risk.

Beyond physical violence, the mental health toll of such discrimination is severe. Dr. Meyer’s decades-long research on minority stress shows that persistent exposure to stigma, prejudice, and discrimination leads to elevated rates of anxiety, depression, suicidal ideation, and self-harm among transgender individuals. Many have already endured bullying, childhood trauma, and conversion therapy, exacerbating their mental health struggles.

Panelists, including Bamby Salcedo of the TransLatina Coalition and Jordan Willow Evans of the Outsider Media Foundation, emphasized the importance of community mobilization and legal action. Advocacy groups are preparing to challenge the order in court, while activists are working to provide support networks for affected individuals.

The executive order represents a significant rollback of rights and protections for transgender and non-binary people. However, the panelists remain committed to fighting back, underscoring the necessity of solidarity, activism, and continued public discourse. They stressed that the impact of such policies extends beyond the LGBTQ+ community, striking at the heart of fundamental human rights and equality in the United States.

Experts drew parallels between the fight for same-sex marriage and the ongoing struggle for trans rights, emphasizing that cultural representation through media plays a crucial role in normalizing LGBTQ+ identities. However, they also noted that trans acceptance within families, particularly regarding trans youth, remains a major battleground.

Panelists pointed out that many Indigenous cultures have long revered gender-diverse individuals, but colonization and religious fundamentalism sought to erase these identities. Despite centuries of oppression, trans communities have persisted and grown stronger. The current political backlash is, in part, a reaction to the progress and visibility the community has achieved.

The political landscape remains a key concern, with conservative movements strategically targeting trans rights through legal and policy mechanisms. Panelists expressed confidence that continued advocacy and legal protections would ultimately safeguard trans rights, but they acknowledged that the current challenges are formidable.

Jordan Evans addressed the controversy surrounding gender-affirming healthcare for minors, arguing that misinformation distorts the conversation. They emphasized that families, in consultation with medical professionals, should be trusted to make decisions in the best interest of their children, criticizing the Republican Party’s stance as contradictory given its usual emphasis on parental rights.

Gael Urquia, a Project TRANS Services Navigator at the San Diego LGBTQ Center, spoke about the mental health toll of the current political climate. They reported a significant rise in anxiety, distress, and self-harm, particularly following Trump’s election and subsequent executive orders targeting trans rights. The uncertainty and hostility directed at trans individuals are having real and dangerous consequences for young people navigating their identities in an increasingly polarized society.

Service providers have reported a surge in inquiries regarding legal name and gender marker changes, reflecting widespread anxiety within the transgender community. According to The Trevor Project, calls to the national LGBTQ+ crisis hotline have increased by 200%, with 45% of transgender youth considering relocation to another state for a more supportive environment. While no significant spike in self-harm has been reported, there is a noticeable rise in hate crimes.

Panelists also discussed the role of government data tracking, expressing concerns that transgender hate crimes might be removed from FBI reports under a new administration. They called on state and local governments to step in and ensure accurate tracking of these crimes. California Attorney General Rob Bonta was commended for affirming that transgender individuals in the state will continue to have access to healthcare and protections, regardless of federal policy changes.

Gael shared a personal account of coming out and transitioning as an immigrant, highlighting the challenges of seeking acceptance within their family. They stressed that understanding a child’s transition is less about complete comprehension and more about prioritizing compassion and well-being. Small affirmations, such as respecting pronouns and chosen names, can profoundly impact a transgender child’s mental health.

The discussion concluded with a call to action, emphasizing the need for continued advocacy, legal protections, and community support in the face of rising discrimination. While institutional challenges persist, the transgender community remains steadfast in its fight for equality, safety, and recognition. Panelists urged collective efforts to counter harmful rhetoric and policies, ensuring that future generations of transgender individuals can live with dignity and security.
